1. Company information

These Terms and Conditions of Sale (“T&Cs”) are provided by:

2. Purpose

These T&Cs govern the booking and provision of private boat excursions with skipper offered by MEDITERRANEE EVASION departing from Mandelieu-la-Napoule, France.

Any booking made via the website mediterraneeevasion.com or via a partner platform implies full and unconditional acceptance of these T&Cs.

In the case of bookings made through a partner platform, these T&Cs apply in addition to the partner platform’s own terms and conditions.

3. Booking and payment

Bookings can be made directly via the website mediterraneeevasion.com or through a partner platform.

Full payment is required at the time of booking through a secure payment system.

Payment of the booking constitutes full acceptance of these Terms and Conditions of Sale, without the need for a handwritten signature.

A booking confirmation is sent to the client by email once payment has been completed.

Additional services or extras (drinks, paddle board rental, etc.) may be paid on site before departure.

4. Participation conditions

The client agrees to:

  • follow all safety instructions given by the skipper;
  • behave respectfully towards crew, other passengers, and equipment;
  • be physically fit to participate in a sea excursion;
  • inform the skipper of any medical condition that could affect safety on board;
  • be able to swim in order to take part in water-based activities.

Minors must be accompanied by a responsible adult at all times.

The maximum number of passengers allowed on board is 6 people. This limit cannot be exceeded for safety and maritime regulations.

5. Delay, no-show, and refusal of boarding

In case of client delay, the excursion may still take place, but the scheduled return time will remain unchanged.

In case of no-show at the departure point and time, no refund will be issued.

The skipper reserves the right to refuse boarding or immediately terminate the service without refund in the following cases:

  • intoxication;
  • excessive alcohol consumption;
  • dangerous, aggressive, or disrespectful behaviour;
  • failure to comply with safety instructions.

Strong alcoholic beverages are strictly prohibited on board.

6. Animals and smoking

Animals are allowed on board only with prior approval from MEDITERRANEE EVASION, limited to a maximum of two animals under 10 kg.

Smoking is strictly prohibited on board the vessel.

7. Paddle board and water activities

Water activities such as swimming and snorkeling are undertaken at the client’s own risk.

Paddle board rental is offered as an optional paid extra and must be reserved in advance, subject to availability.

The client remains responsible for the use of any equipment provided.

7 bis. Meals and wines – Services and purchases on your behalf

The meals and wines offered during your boat excursions are purchased on your behalf from local producers and wine merchants.

MEDITERRANEE EVASION does not sell food or alcoholic beverages. It only provides the following services:

  • organization and preparation of meals on board
  • purchase of products and transport to the boat
  • setup and service on board

The price displayed for a meal or wine tasting is indicative only.

The exact amount of products will be invoiced at cost price, based on receipts and invoices issued by shops or wine merchants.

You only pay for the products actually consumed, plus the service fee for preparation, delivery, and organization.

This arrangement allows guests to enjoy a personalized meal or wine tasting experience on board, while fully complying with applicable regulations: no products are resold, and the service is strictly an organizational and logistical service.

8. Weather conditions and safety

Safety at sea is the top priority.

The skipper has sole authority to decide whether to maintain, cancel, modify, or postpone the excursion depending on weather conditions, safety, or navigation constraints.

In the event of cancellation due to weather or safety reasons:

  • a priority rescheduling will be offered to the client;
  • if no alternative date is available, a full refund will be issued.

9. Cancellation by the client

The client may cancel free of charge up to 7 days before the scheduled departure.

Within this period, the client may choose:

  • a full refund; or
  • a rescheduling, subject to availability.

Cancellations made less than 7 days before departure are non-refundable, except in exceptional cases at the discretion of MEDITERRANEE EVASION.

10. Exceptional circumstances and force majeure

MEDITERRANEE EVASION shall not be held liable for non-performance or modification of the service due to force majeure or events beyond its control, including but not limited to:

  • technical failure;
  • administrative decision;
  • maritime restrictions;
  • port closure;
  • extreme weather conditions;
  • strikes;
  • health crises;
  • or any unforeseeable event preventing the execution of the service.

In such cases, rescheduling or a refund may be offered depending on the circumstances.

11. Liability

The client is liable for any damage caused intentionally or through negligence to the boat, equipment, or onboard facilities.

Any damage may be subject to additional charges.

Personal belongings remain under the sole responsibility of the client. MEDITERRANEE EVASION shall not be held liable for loss, theft, or damage to personal items.

MEDITERRANEE EVASION holds professional liability insurance in accordance with applicable regulations for boat rental with skipper services.

12. Modification of the service

MEDITERRANEE EVASION reserves the right to modify the itinerary, schedule, anchoring location, or any other element of the service for safety, weather, technical, or operational reasons.

Such modifications shall not entitle the client to compensation when justified by safety or proper execution of the service.

13. Image rights

During the excursion, photos and videos may be taken for communication and promotional purposes.

Unless the client objects in writing before departure, the client authorises MEDITERRANEE EVASION to use such images on its communication channels, including its website, social media, and marketing materials.

14. Personal data

Personal data collected during bookings is processed in accordance with applicable data protection regulations, including the General Data Protection Regulation (GDPR).

The client has the right to access, rectify, object to, and delete their personal data.

15. Consumer mediation

In accordance with Articles L.611-1 and following of the French Consumer Code, the client has the right to use a free consumer mediation service to resolve disputes amicably.

After a written complaint submitted to MEDITERRANEE EVASION, the client may contact the following mediator:

16. Governing law and jurisdiction

These T&Cs are governed by French law.

In the event of a dispute, the parties shall first seek an amicable solution.

Failing an amicable agreement, jurisdiction is expressly attributed to the courts of Grasse, France.

The French version of these Terms and Conditions shall prevail in case of any discrepancy or difference in interpretation over any translated version.
